Auction Regulations – Gallery 74
Gallery 74 is a business that operates on behalf of the sellers and most of the time
the gallery does not own the items offered for sale.
Gallery 74 or the seller/owner of the item are not responsible for the quality of the
items or the correctness of the description of the item and any bidder or buyer
will be considered to have inspected the item and the item to his full
satisfaction.
Since some of the items offered for sale are antique, old and used items, sometimes
it is not possible to describe the condition of the items and the buyer must
check them and all the bidder and / or the buyer will be considered to have
checked the item, and the item is to his satisfaction.
The description of the item, whether in writing or verbally, including the
valuation and/or any other information regarding the item on the part of
Gallery 74 are intended to help the buyer only and should not be considered a
commitment or a representation that Gallery 74 has any responsibility or
liability regarding it.
Gallery 74 has no obligation to sell all the items offered for sale and is entitled to
add or remove items from the sale at any time.
Participation in the sale via the Internet is conditional upon pre-registration and approval
of the buyer by Gallery 74, physical participation or by telephone is
conditional on providing complete details including an ID number, approval of
the buyer by Gallery 74 and providing an identification number for the sale.
Gallery 74 reserves the right not to approve a buyer or disqualify a buyer after
approval from its considerations and without commitment on its part.
The sale will be managed by the sales managers who are also the announcers, they
will describe the items, manage the sale and determine who wins each item.
The sale catalog will be published on the website and at the place of sale during
the display and sale and will include the items offered for sale and their
description, in any case where there is a deviation or contradiction between
what is written in the catalog and the wording of the sales manager, what is
written in the catalog should be considered as more correct information, but
without any commitment on the part of Gallery 74.
Gallery 74 will display the items offered before the sale for at least four days so
that bidders and buyers can check them.
Gallery 74 offers participants in the sale to come to the preview and examine the items.
The sale will be managed according to the order of the catalog, but the sale
manager will be able to return or skip to the items at his discretion.
Each item will be opened at the minimum price listed in the catalog and will
increase in varying price jumps depending on the price of the item.
The sales manager will be able to change the gaps or the minimum price despite what
is listed above.
As soon as a buyer is determined for the item by the sales manager, the buyer will
be considered the one who bought the item and must pay for it the hammer price
in USD plus a commission of 19% + VAT (the VAT is on the commission only.)
according to the last representative rate that was known before or at the time
of sale.
Payment for the items will be made in cash up to an amount of NIS 6,000, by bank
transfer or credit cards.
Customers who wish to pay by check will be able to receive the items only after the check
has been paid.
The buyer must make sure to pay and receive the items from Gallery 74 (the pick-up
and payment location will be announced to buyers at each sale) within seven
days of the sale.
A buyer who is late beyond seven days will pay an additional commission of 5% of
the price of the hammer (the VAT on the commission only).
A customer from Israel or abroad who requests to receive the item, will be able
to receive it by regular delivery or by a courier on his behalf and at his own
expense and will pay an additional fee for packaging services, once the item
has been paid for and left the gallery, Gallery 74 will no longer be
responsible for the item in any way.
Despite the above, any claim by a buyer regarding a certain item after the purchase of
the item must be made in writing within 14 days from the date of sale, Gallery
74 will check the claim and if it turns out to be justified, the sale of the
item will be canceled, and the money will be returned to the customer.
Any claim or agreement between the buyer and Gallery 74 prior or otherwise to these
regulations is void.
No commission will be added to those paying by credit card.
The gallery is not responsible for damage caused to the item as a result of
shipping, the responsibility will apply to the customer since the gallery
provides this service to facilitate the collection of the item for your
convenience only.
Any claim or desire to sue on the part of the customer will be conducted
exclusively in a court in Tel Aviv
As far as gems and diamonds are concerned, from the moment the item leaves the
gallery, no claim will be accepted regarding the item, the responsibility of
the seller or any person on his behalf to check the item at the moment of
delivery, whether by delivery or self-collection.
The buyer/bidder confirms that he has read the regulation and understood its content.
Annex
to the regulations – diamond sales to bidders – buyers
Bids in diamond auctions must be submitted in writing to the auction house, and/or
on the Gallery 74 website after the buyer’s registration and approval by the
auction house, and/or on a web platform where the auction house publishes the
auction.
Bids submitted to the auction house are in USD only.
As far as diamonds are concerned, Gallery 74 emphasizes to each customer and
suggests checking with great care and under his full and sole responsibility,
all types of goods offered for sale, including the contents of each
package/box/wrap, its value, the nature of the goods and any data that is
relevant, and it is emphasized that Gallery 74 and / or whoever on her behalf
has no responsibility and will not have any responsibility of any kind
regarding the package/box/wrap, its value, the nature of the goods and any data
that is relevant.
The customer/bidder knows that the submission of a bid is final and binding and gives
the bidder’s consent to this condition.
Gallery 74 does not own the goods offered for sale, therefore it is hereby emphasized
that the diamonds offered for sale are offered and will be sold AS-IS, Gallery
74 makes all possible efforts in examining the diamonds offered for sale,
including the examination of the diamonds by professionals, gemological
assistants and of course the examination of the gemological certificates
attached to the diamonds offered for sale, Despite this, it is emphasized that
the buyer/bidder must carefully check the diamonds in all parameters, chips on
the diamonds, treatments done on the diamonds including color treatments, with
an emphasis on diamonds with blue and green colors and diamonds with a green
hue suspected to have come from diamond mines in Zimbabwe, etc., and to inform
to the staff of the auction house, and the buyer/bidder declares that after the
purchase no claims of any kind will be accepted regarding any problem and/or
data regarding any diamond offered in the sale.
In order to maintain the privacy of the sellers and buyers, the names of the
sellers and buyers will not be published, and in addition, the auction house
will not be required to present the appendix containing the names of the
certificate holders and their office details.
Gallery 74 reserves the exclusive right to decide whether or not to sell the items
offered for sale.
Notifications to winners and sellers will be delivered up to 2 business days.
It is hereby emphasized that proposals for the purchase of diamonds will only be
accepted from holders of a license to deal with diamonds and/or holders of a
jeweler’s license (for the purpose of setting the diamonds in jewelry).
The goods will be received after the payment has been made only at the Moti Kashi
office
The payment for the purchases must be made within 48 hours from the date of winning
the order of “Moti Kashi” company (the office responsible for
receiving the payments for the purchases), by cash only check that includes the
auction house fees and/or bank transfer that includes the auction house fees.
Each bidder must deposit an amount of $1,500 USD in order to receive the approval of
the auction house to participate in the sale.
An addition to each purchase 7.85% of the total purchase amount will be added to
the purchase invoice
A buyer/bidder who improved the conditions of the tender will be expected to be
fined the amount of the deposit.
Gallery 74 Auction House and/or those on their behalf are not obligated to accept an
offer submitted in writing and/or on the Internet platforms, and may at any
time cancel an offer at its sole discretion, and/or return to publication,
without an obligation to give reasons for their decision.
The buyer/bidder confirms that he has read the regulation and understood its
